Debt Collection Policy

Burchills Engineering Solutions (Burchills) relies on payment of invoices by the due date to ensure we can pay our employees and operating expenses. Burchills aims to resolve debtor issues promptly and in a fair manner. The basis for providing credit, invoicing, collection, and dispute resolution shall be with due regard to the client/consultant contract for the works and applicable legislation, including the Building Industry Fairness (Security of Payment) Act 2017 (Qld). The following policy sets out our debt collection procedures in accordance with Burchills standard client contract terms.

Invoices
Any query or discrepancy with invoices issued should be raised by the client promptly. Any query or dispute will be dealt with promptly, transparently and in good faith.

Where an invoice constitutes a payment claim under the Building Industry Fairness (Security of Payment) Act 2017 (Qld), any client who does not intend to pay the full amount claimed must provide a valid payment schedule in accordance with the Act within the earlier of the contractual timeframe or 15 business days after receipt of the payment claim.

A payment schedule must identify the invoice, state the amount proposed to be paid, and include reasons for any difference.

Burchills may issue statements, email and/or call the client to clarify invoice status from time to time.

Payment is due on the due date specified in the contract and/or stated on the invoice. Where the contract does not specify a due date, payment will be due in accordance with applicable legislation.

Security Notice: NEVER change your payment bank account details for Burchills on the basis of receiving emails advising to do so. ALWAYS confirm any changes to bank accounts by calling Burchills accounts

Overdue Invoices
Invoices not paid by the due date are considered overdue and are subject to our escalation procedures.
We will work with you to understand any reasons for non-payment and seek to resolve issues promptly and fairly.
If an invoice remains unpaid after the due date, Burchills may exercise its rights under the contract and applicable law, including charging interest, suspending work (with required notice), reviewing or withdrawing credit terms, requiring payment before recommencement, and taking recovery action, including adjudication or legal proceedings.

Payment Agreements
If necessary, we may negotiate with you a payment agreement, approved by Burchills’ Managing Director.
Agreements will be made on a case by case basis and may include provision of security, personal guarantees, payment plans, interest costs, stand down and restart costs, legal & administrative costs.

Default
If payment is not received for overdue invoices or if the terms of a payment agreement are not complied with, Burchills will seek legal advice and may instigate legal action to recover outstanding amounts and additional costs.
We will notify you of our intention to commence legal action.
